BIG COVE PUBLIC NOTICE

TO: People of Big Cove

RE: Regulations regarding logging and removal of gravel/topsoil from Reserve lands

FR: Chief & Council

Please be advised that logging activities on and removal of gravel/topsoil from the Big Cove Indian Reserve is strictly prohibited according to Indian Act regulations.

Indian Act regulations (Section 93) state that removal of timber, gravel, soil and other natural resources from Reserve lands and lands purchased by the Band through the Land Claims Agreement and the Land Acquisition Committee may only take place with a permit issued by the Minister of Indian Affairs.

To date, no such permits have been issued by the Minister. Therefore, any person engaged in activities such as logging on and removal of gravel/topsoil from the Big Cove Reserve and lands purchased by the Band is guilty of an offence as per Sections 93 and 103 of the Indian Act.

If you have any questions or concerns regarding this matter, do not hesitate to contact Chief Robert Levy at (506) 523-3471 or the Band Administrator at (506) 523-4669.

RE: By-Law Respecting the Control of Dogs on the Reserve

FR: Big Cove Chief & Council

On April 19, 1999, the Chief & Council had updated the February 7,1994 Big Cove Indian Band By-Law Respecting the Control of Dogs on the Reserve. Accordingly, we have directed the Big Cove Police to enforce this by-law effective immediately.

The following are major points of this by-law:

· Dogs must be safely tethered, penned up or on a leash at all times;

· No owner shall allow a dog to remain unfed or neglected or otherwise cause a dog to become a nuisance;

· No owner shall permit a female dog in heat to be off the owner's premises;

· Every dog shall be spayed or neutered;

· Dogs may be seized by a dog control officer for violation of this by-law;

· Dogs may be reclaimed within 5 days providing the owner pays expenses incurred in securing and caring for the dog;

· If a dog is unclaimed after 5 days, it may be destroyed or disposed of without compensation to the owner;

· Each household and each person living alone desiring to keep a dog shall apply for permission to do so and shall obtain a permit for such dog upon payment of a fee in an amount set out in this by-law;

· Every person who contravenes any of the provisions of this by-law is guilty of an offence and is liable on summary conviction to fine of not more than five hundred dollars ($500) or to imprisonment for a term not exceeding thirty (30) days, or both.

On April 19,1999, the Chief & Council amended this by-law setting dog registration fees at fifty dollars ($50) per dog. This fee shall come into effect upon ratification of this amendment by the Department of Indian Affairs.
